Dear CDMSI members, observers and participants,

I would like to inform you that the Secretary General of the Council of 
Europe had invited the Swiss Institute of Comparative Law to prepare a 
study on blocking, filtering and take-down of Internet content across 
all the Organisation member States. This Study was finalised by the end 
of 2015. The comparative Study has two parts the first one is composed 
of 47 country reports and the second is a comparative analysis.

The Secretary General shared some of its preliminary conclusions in the 
meeting of the Ministers’ Deputies on 10 February 2016 and sent each 
Permanent Representation the part related to their country to send 
comments if they wish to do so by 31 March 2016.

Particularly on the question of the role of Internet intermediaries, he 
mentioned the complexity of the issue and the future work of the CDMSI 
in a draft recommendation on Internet intermediaries.

The Secretary General also announced that, based on the analysis and the 
comments received, he will present a final assessment of the situation 
at the Ministerial meeting in May 2016, together with some follow-up 
proposals.

As the Comparative Study is an initiative of the Secretary General we 
will inform you about possible decisions as to its publication.

Chers membres, observateurs et participants du CDMSI ?

Je vous informe que le Secrétaire général du Conseil de l’Europe a 
mandaté l’Institut suisse de droit comparé pour préparer une étude sur 
le blocage, le filtrage et la suppression de contenus d’internet dans 
tous les Etats membres de l’organisation. Cette étude a été terminée fin 
2015. Elle est en deux parties : un recueil de 47 rapport pays et une 
analyse comparative.

Le 10 février 2016, le Secrétaire général a transmis certaines des 
conclusions préliminaires au Comité des Ministres et a envoyé à chaque 
représentation permanente la partie qui la concerne, avec une invitation 
à lui faire éventuellement des commentaires avant le 31 mars 2016. Sur 
la question particulière du rôle des intermédiaires d’internet, il a 
souligné la complexité de la question et les futurs travaux du CDMSI 
pour un projet de recommandation sur le sujet.

Le Secrétaire général a également annoncé qu’à la réunion ministérielle 
de mai 2016, il présenterait une évaluation finale de la situation avec 
des propositions de suivi sur la base de l’analyse et des commentaires 
qu’il aura reçus,

L’étude comparative étant une initiative du Secrétaire général, nous 
vous informerons d’une éventuelle décision quant à sa publication.
