Nombres de dominio: una expresi?n que merece ser protegida
Recomendaciones y sugerencias para administradores locales de Am?rica Latina y el mundo
El Sistema de Nombres de Dominio (DNS) es clave para que Internet funcione tal como la conocemos. Sin este sistema, los usuarios deber?an aprender y reproducir largas cadenas de caracteres alfanum?ricos para acceder a un sitio. Adem?s, los nombres de dominio pueden ser pensados, en s? mismos, como formas de expresi?n y opini?n.
Por lo tanto, todo lo relacionado con el registro o no renovaci?n de los mismos deber?a someterse a los est?ndares que protegen estos derechos fundamentales. De esto se desprende que el dise?o institucional de quienes administran los ccTLDs (dominios de nivel superior geogr?fico) es una cuesti?n clave.
La Iniciativa por la Libertad de Expresi?n en Internet (iLEI) del CELE analiza en este documento los distintos modelos que los administradores nacionales de ccTLDs han adoptado. Este trabajo identifica las virtudes y defectos que, desde el punto de vista del ejercicio de la libertad de expresi?n, presentan, por un lado, el Modelo de Administraci?n con Alta Injerencia Estatal y, por otro, el de M?ltiples Partes Interesadas, que cuenta con participaci?n de la sociedad civil. Asimismo, analiza, en particular, el caso argentino.
Al final del documento, se presentan una serie de recomendaciones para los Estados y organismos administradores a fin de que la asignaci?n de nombres de dominio vaya en consonancia con los est?ndares internacionales en materia de derechos humanos en l?nea.

ACERCA DEL CELE
?
El Centro de Estudios para la Libertad de Expresi?n y Acceso a la Informaci?n (CELE) fue creado en el a?o 2009 en el ?mbito de la Facultad de Derecho de la Universidad de Palermo con el objetivo de proveer de investigaciones y estudios rigurosos a sectores de la sociedad civil, periodistas, instituciones gubernamentales e instituciones acad?micas dedicados a la defensa y a la promoci?n de estos derechos, especialmente en Am?rica Latina. La creaci?n del CELE responde a la necesidad de construir espacios de debate y estudio dedicados a reflexionar sobre la importancia, los contenidos y los l?mites de estos derechos en la regi?n. Para esto, el centro se propone dialogar y trabajar en conjunto con otras unidades acad?micas del pa?s y de Latinoam?rica.
El CELE tiene como objetivo
principal que sus investigaciones se
constituyan en herramientas ?tiles
para periodistas, instituciones
gubernamentales, sectores privados y
de la sociedad civil dedicados a la
defensa y promoci?n de estos
derechos, especialmente en Am?rica
Latina. Teniendo en cuenta este
objetivo, adem?s de los estudios que
considere necesarios, el centro
encarar? investigaciones solicitadas
por estos grupos.

Domain Names: an expression worth protecting
Recommendations and suggestions for local administrators of Latin-America and the world
The Domain Name System is of key importance for the Internet to work as we know it. Without it users would be obliged to remember and reproduce long sequences of numbers, letters and symbols for accessing a web site. Furthermore, domain names could be considered on their own as forms of expression and opinion.
As such, everything related to the registry of, or denial to renew, a domain name, should be subject to the tests that protect fundamental rights. This way it could be implied that the institutional design of the organizations that administer the different ccTLDs (country code Top Level Domain) is of vital importance.
In this document the Freedom of Expression on the Internet Initiative (iLEI) of the Center for Studies on Freedom of Expression and Access to Information (CELE) analyzes the various models adopted by the national ccTLD administrators. It identifies the virtues and flaws that an Administrative Model with High State Interference and an Administrative Model with Multi-Stakeholders Perspective could have from a freedom of expression perspective. As an example, it takes special care of the Argentinean case.At last, some recommendations for the Governments and administrators are offered hoping that the domain name allocation process fall in line with the international standards of online human rights.

About CELE ?

The Center for Studies on Freedom of Expression and Access to Information (CELE) was founded in 2009 at the Palermo University Law School with the objective to provide rigorous research and studies to sectors of civil society, journalists, government institutions and the academic community that are dedicated to the promotion of those rights, primarily in Latin America. CELE was created in response to a need to construct spaces for debate and study dedicated to reflecting on the importance and the limits of freedom of expression and access to public information in the region. In order to accomplish this, the center proposes to create dialogue and collaborate with other academic entities in Argentina and in Latin America.
CELE's principal objective is to
produce reports that can be useful
tools for those journalists,
governmental institutions, and
members of the private sector and
civil society that are dedicated
to the defense and promotion of
these rights, especially in Latin
America. In accordance with this
objective, CELE will undertake
research at the request of the
aforementioned groups in addition
to undertaking studies that CELE
considers to be necessary.

Bertoni, a professor at Palermo
University Lawschool and former
Special Rapporteur for Freedom of
Expression at the Organization of
American States.
