Vigilancia en la red: ?qu? significa monitorear y detectar contenidos en Internet?
De manera creciente, los gobiernos alrededor del mundo reclaman su soberan?a en Internet. Y, aunque en algunos casos estas intervenciones devienen en formas de censura oficial, en muchos otros obedecen al inter?s de defender principios que las constituciones consagran y los ciudadanos exigen.
El ejemplo m?s reciente lo tenemos en Argentina. Un proyecto de ley presentado en el Congreso? propone la creaci?n de un observatorio para "detectar, combatir y denunciar" expresiones de acoso, discriminaci?n y violencia en Internet. En el mismo sentido, pero un paso m?s adelante, pa?ses como Alemania, Francia o Brasil han aplicado normas gen?ricas o espec?ficas para prevenir la difusi?n en Internet de contenidos ofensivos o pol?ticamente sensibles.
El prop?sito de monitorear y detectar contenidos en l?nea afecta al ciudadano e impacta en la arquitectura de la red. Adicionalmente, implica a los intermediarios de Internet, que se valen de tecnolog?as como la Inspecci?n Profunda de Paquete para cumplir con ese cometido. 
Vigilancia en la red: ?qu? significa monitorear y detectar contenidos en Internet?es un documento de la ?Iniciativa por la Libertad de Expresi?n en Internet? (iLEI), del Centro de Estudios en Libertad de Expresi?n y Acceso a la Informaci?n (CELE) de la Facultad de Derecho de la Universidad de Palermo, que analiza el creciente inter?s de los gobiernos en monitorear la red.? En primer lugar, ofrece un marco conceptual general sobre la arquitectura de Internet. Posteriormente, analiza el concepto de control en Internet, haciendo ?nfasis en los intermediarios y en el uso de tecnolog?as como la Inspecci?n Profunda de Paquete. Por ?ltimo, plantea la tensi?n entre la seguridad nacional y la prevenci?n de la violencia, y derechos como la libertad de expresi?n y la privacidad.
Entre otras recomendaciones, este documento exhorta a las autoridades a que lleven a cabo estudios de impacto en derechos humanos cuando promuevan iniciativas que buscan regular el uso de Internet. ?stas deben, adem?s, ser el resultado de un debate transparente y abierto sobre el futuro de la red en una sociedad democr?tica.

ACERCA DEL CELE

El
Centro de Estudios para la Libertad de Expresi?n y Acceso a la Informaci?n (CELE) fue creado en el a?o 2009 en el ?mbito de la Facultad de Derecho de la Universidad de Palermo con el objetivo de proveer de investigaciones y estudios rigurosos a sectores de la sociedad civil, periodistas, instituciones gubernamentales e instituciones acad?micas dedicados a la defensa y a la promoci?n de estos derechos, especialmente en Am?rica Latina. La creaci?n del CELE responde a la necesidad de construir espacios de debate y estudio dedicados a reflexionar sobre la importancia, los contenidos y los l?mites de estos derechos en la regi?n. Para esto, el centro se propone dialogar y trabajar en conjunto con otras unidades acad?micas del pa?s y de Latinoam?rica.

El CELE tiene como objetivo principal que
                            sus investigaciones se
                            constituyan en herramientas ?tiles para
                            periodistas, instituciones
                            gubernamentales, sectores privados y de la
                            sociedad civil dedicados a
                            la defensa y promoci?n de estos derechos,
                            especialmente en Am?rica
                            Latina. Teniendo en cuenta este objetivo,
                            adem?s de los estudios que
                            considere necesarios, el centro encarar?
                            investigaciones solicitadas
                            por estos grupos.

El director del CELE es Eduardo Bertoni,
                            Profesor de la Facultad de
                            Derecho de la Universidad de Palermo y
                            ex-Relator Especial para la
                            Libertad de Expresi?n en la Organizaci?n de
                            los Estados Americanos.

CELE launches new document

Vigilance on the Internet: What does it mean to monitor and detect online content?

Increasingly, governments around
                                the world are demanding sovereignty on
                                the Internet. Although in some cases
                                these interventions become forms of
                                official censorship, in many others they
                                obey an interest to defend principles
                                that constitutions establish and
                                citizens
                                demand.
The most recent example occurred here in Argentina. A draft bill presented in the Congress proposes the creation of an observatory to ?detect, combat and report? expressions of harassment, discrimination and violence on the Internet. On the same path, but a step ahead, countries like Germany, France and Brazil have applied general or specific norms to prevent the diffusion of offensive or politically sensitive content on the Internet.
The intention to monitor and detect online content affects citizens and impacts the architecture of the Internet. Additionally, it implies that online intermediaries should consider technologies such as Deep Packet Inspection to complete this task.
Vigilance on the Internet: What does it mean to monitor and detect online content? is a document from the Initiative for Freedom of Expression on the Internet (iLEI) at the Center for Studies on Freedom of Expression and Access to Information (CELE) of the University of Palermo Law School. The document analyzes the increasing interest of governments in monitoring the Internet. First, it offers a general conceptual framework on the architecture of the Internet. It then analyzes the concept of control on the Internet, putting emphasis on intermediaries and the use of technologies like Deep Packet Inspection. Finally, it explores the tension between national security and violence prevention, and the right to freedom of expression and privacy.
Among other recommendations, the document calls on authorities to carry out human rights impact studies when they promote initiatives that seek to regulate use of the Internet. Such initiatives should also be the result of an open and transparent debate about the future of the Internet in a democratic society.

The Center for Studies on Freedom of Expression and Access to Information (CELE) was founded in 2009 at the Palermo University Law School with the objective to provide rigorous research and studies to sectors of civil society, journalists, government institutions and the academic community that are dedicated to the promotion of those rights, primarily in Latin America. CELE was created in response to a need to construct spaces for debate and study dedicated to reflecting on the importance and the limits of freedom of expression and access to public information in the region. In order to accomplish this, the center proposes to create dialogue and collaborate with other academic entities in Argentina and in Latin America.

CELE's principal objective is to produce
                              reports that can be useful
                              tools for those journalists, governmental
                              institutions, and members of
                              the private sector and civil society that
                              are dedicated to the defense
                              and promotion of these rights, especially
                              in Latin America. In
                              accordance with this objective, CELE will
                              undertake research at the
                              request of the aforementioned groups in
                              addition to undertaking studies
                              that CELE considers to be necessary. 

CELE's director is Eduardo Bertoni, a
                              professor at Palermo University
                              Lawschool and former Special Rapporteur
                              for Freedom of Expression at
                              the Organization of American States.
